With the fall of the ruble exchange rate, the economic situation in the country worsened. Many families who took advantage of mortgage programs began to experience difficulties in repaying their debt. To help borrowers, the Government signed a Decree regulating the scheme and methods for implementing loan restructuring. Read the article for details about the mortgage borrower assistance program.
Who will the government help pay off their mortgage debt?
The government is ready to help borrowers who are citizens of the Russian Federation subject to certain conditions:
- the client documents a decrease in family income of more than 30%;
- the income per family man after taking into account the mortgage contribution is less than one and a half subsistence minimums;
- there is no information that the person has been declared bankrupt in court.
- the family is a participant in a federal or municipal program to optimize housing conditions and has taken out a preferential mortgage;
- there are one or more minor children in the family;
- the borrower is a combat veteran, disabled or has a disabled child;
- the client is a government employee with at least 1 year of experience.
Options for government support for borrowers
There are several alternative options for helping insolvent debtors.
- The loan currency is converted into national currency at the current exchange rate.
- The rate on a foreign currency loan is set no higher than 12% per annum. The rate on a ruble loan is fixed until the end of the lending period.
- The current payment is reduced to 50% for up to one and a half years. In this case, the underpaid amount is carried forward to subsequent periods.
- The client’s financial obligations are reduced by 10% of the debt balance, but not more than RUB 600,000.
- The bank does not charge the client any fees for restructuring.
The choice of restructuring option depends on the specific terms of the agreement: the currency of the loan, its validity period, etc. The lender is not obliged to write off fines and penalties accrued to the client for late payment, but may do so at his own discretion.
Government Resolution 373
On April 20, 2015, Government Resolution No. 373 became valid. According to this document, certain categories of borrowers received the right to loans in national or foreign currency. This includes the following cases:
- family income decreased by more than 30%;
- Due to the depreciation of the ruble, loan payments in foreign currency increased by more than 30%.
Restructuring in this case involves the following adjustments to the terms of the contract:
- reduction of the current contribution for a period of no more than 1 year;
- partial write-off of the debt body;
- change in the loan rate – no higher than 12% per year.
When restructuring mortgage loans, creditor banks have the opportunity to return part of the lost profit within 6-12 months. For one loan, the permissible repayment limit is 10% of the loan balance, but not more than 600 thousand rubles.
In addition, the authorized capital of OJSC AHML was additionally financed by 4.5 billion rubles. This means that even more families will be able to count on assistance from the state.
Where to contact
To take advantage of the program, the borrower must contact his lender with a corresponding application. The website of the Mortgage Lending Agency shows that they have entered into a cooperation agreement with AHML.
Assistance program from AHML
AHML is only the regulator of the assistance program; this organization does not make decisions on mortgage restructuring. If the creditor agrees to this procedure, AHML will compensate the financial institution for losses based on the corresponding application.

Conditions for assistance to mortgage borrowers
At the time of filing an application for restructuring, the loan agreement must be valid for at least 1 year. The security can be a pledge of housing put into operation or a pledge of rights of claim under an agreement for participation in shared construction. The main requirements for the collateral object are:
- the property is located in Russia;
- the total area of the property is no more than 45, 65 or 85 square meters. m for a one-room, two-room and three-room house/apartment;
- cost of 1 sq. m of real estate does not exceed by more than 60% the cost of typical housing at the time of signing the initial transaction.
If there are three or more children in the family, the last point may not be observed. The premises in which the borrower's family lives must be the only one. The borrower or his family members are allowed to have a share in the ownership of other real estate, but not more than 50% in each premises.
Documents for registration
To take advantage of the restructuring program, the borrower must submit a corresponding request to the bank. Attached to this document:
- Photocopies of the passport of the borrower, mortgagor, and members of their families. For children - birth certificate.
- Marriage/divorce certificate.
- Confirmation of income: salary certificate and copy of the work book, certificate from the pension fund, certificate of state. entrepreneur registration and tax returns, certificate from the employment center, etc.
- Loan documents:
- loan agreement;
- mortgage payment schedule at the time of receiving the loan and at the time of filing an application for restructuring;
- extract from the Unified State Register of Real Estate Rights;
- agreement for participation in shared construction;
- assessment of collateral at the time of loan receipt.

One of the methods of helping the population is to reduce the size of the debtor’s obligations. This can happen through:
- converting the loan currency into rubles;
- interest rate reduction;
- one-time forgiveness of part of the debt.
When using the third mechanism, the state compensates the creditor for losses, i.e. lost profit.

The requirements for debtors have been established
Persons who have n/l children, disabled children, or who are classified as combatants can count on assistance.
On the date of applying for restructuring, the total income of the citizen who took out the mortgage, divided by the number of all members of his family, excluding the mortgage payment, is 1.5 times below the subsistence level.
The person who received the loan can document a decrease in the total income of his family for the last three months before applying for restructuring by more than 30% relative to the average monthly earnings for the last calendar year, or an increase in the payment under the loan agreement by more than 30% compared to previously produced.
The registration of a mortgage loan must precede the 12-month period for a citizen to apply for economic support.
Conditions for a mortgage loan
The conditions that the issued mortgage loan must meet are determined:
- the purpose of the issued loan is shared construction, major repairs or other inseparable improvement of housing, or refinancing of a loan issued for these purposes;
- late payments on the loan last from 30 to 120 days inclusive from the date of application;
- The mortgage loan was issued starting from 01/01/15.
The credit institution that issued the loan must be a participant in the program. Otherwise, obtaining support is impossible.
Requirements for mortgaged residential property
The following requirements apply to property secured by a mortgage agreement:
- Mortgage housing is the only one for a citizen, while the person who has taken out a residential loan is allowed to own a common part of the ownership of another dwelling, but not more than 1/2 in any housing facility;
- cost of 1 sq.m. Mortgage property should not be more than 50% higher than the similar price prevailing in the secondary or primary housing market, the calculation of which takes into account regional cost indicators and information from the statistical body at the time of concluding the loan agreement.
For borrower families with 3 or more children, requirements regarding the price and area of mortgage housing are not applied.
For the possibility of applying state support to a borrower under the assistance program of JSC AHML within the framework of Resolution No. 373, the size of the debt on the mortgage loan, the currency of the loan and the facts of the borrower’s participation in previous restructurings are not important.
AHML borrower assistance program: package of documents for participation
The list of documents requires the borrower to confirm its compliance with the conditions of the 2017 state mortgage restructuring program with the help of AHML.
This includes the following documents:
- application for restructuring - the form is filled out at the credit institution personally by the borrower or a bank specialist;
- certificates, certificates, certificates confirming the citizen’s attitude to the categories established by Resolution No. 373 (on the birth of children, on participation in hostilities, on disability);
- information about the borrower’s financial condition, indicating a drop in his level of well-being by more than 30% (2 personal income tax certificates, from the employment center, tax returns, etc.);
- copies of the loan agreement, payment schedule, certificate from the mortgagee, appraisal report of the collateral at the time of loan processing, etc.
- agreement on shared participation in housing construction;
- extracts from the Unified State Register of Real Estate issued by Rosreestr as collateral for a mortgage loan, other real estate owned by the borrower and his family members.
The final list is compiled by the financial institution and clarified by the borrower directly with the lending bank.
The validity period of the mortgage borrower assistance program was extended at the government level by decision No. 127 dated February 10, 2017 until May 31, 2017 inclusive (further extension is possible). Reimbursement under the AHML mortgage loan borrower assistance program is provided for housing loans for which restructuring agreements were concluded before May 31, 2017.
You can receive monetary program support as mortgage assistance from the state AHML at the lending bank (its successor in the event of the first being deprived of its license or in the event of its bankruptcy) at the place where the restructured loan was concluded. The main condition of the AHML assistance program for mortgage borrowers is the participation in it of the bank that issued the mortgage loan.
Form and amount of support under the AHML assistance program
In accordance with the edition of Resolution 373 of 2017, the maximum amount of compensation for each loan for families with two or more children was increased to 30% of the balance of its amount as of the date of conclusion of the restructuring agreement, but not more than 1.5 million rubles.
The borrower independently chooses one of the forms of providing him with economic state assistance established by the government under the AHML assistance program:
- writing off the loan amount in a single payment;
- reducing the amount of the obligatory payment made every month on the loan for a period of up to 12 months in total for the entire period up to 200 thousand rubles;
- forgiveness of part of the debt when the loan currency is changed to ruble;
- transfer of a foreign currency loan into a ruble loan;
- failure to make payments on the principal debt for a certain period with their postponement to a later date.
The maximum possible amount of support is a reduction of the loan amount by 10% of the outstanding debt.
Important! The volume of assistance provided per borrower cannot exceed 1.5 million rubles, and for a foreign currency mortgage loan - the rate is reduced to no more than 12% per annum for the period of validity of the loan agreement, for a ruble mortgage - to the rate the amount of which is applicable during restructuring.
An increase in the rate is possible only if the borrower significantly violates the terms of the loan. Charging borrower fees or charges for assistance in the Mortgage Assistance Program is prohibited. The support applies only to loan payments, excluding other obligations of the borrower, for example, those associated with insurance or appraisal.
After another collapse of the Russian ruble in 2014-2015. Mortgage borrowers who took out loans in foreign currency were faced with the need to pay huge sums to the bank. And not at all what they expected when concluding the loan agreement. Having fallen into financial bondage, they turned to the state for help.
At first, officials of all stripes convinced dissatisfied citizens that the sharply increased debt was a consequence of their greed and improvidence. But then the statesmen nevertheless developed a program to help mortgage borrowers. True, not for all debtors affected by a significant drop in the national currency.
The assistance program has been in effect since 2015. However, there were so many people who wanted to solve their financial problems at the expense of the state that the budget funds allocated for the project ran out, and the project itself was curtailed.
But at the end of the summer of 2017, the state decided to extend the program. On August 11, 2017, government decree No. 961 was issued on further measures to support mortgage holders who find themselves in a difficult financial situation. Some changes have been made to the previously existing program. From its contents it became clear that the state was completely focused on supporting hapless foreign currency debtors.
The new program has a number of features:
- Help for citizens with unsustainable mortgage debt is provided through its restructuring. This means that the loan is not forgiven, but the bank renews a new loan agreement with the client, with more favorable conditions for the borrower. Or draws up an additional agreement to the old one. The main purpose of the documents drawn up is to reduce the financial burden on the debtor and make the loan agreement enforceable.
- No more than 30% of the mortgage debt is compensated at public expense. In this case, the maximum possible amount that can be allocated for partial repayment of the loan is 1.5 million rubles.
- The state warns that the assistance is provided one-time, and in future risky transactions with the bank, citizens will have to rely solely on themselves.
When repaying part of the debt through the assistance program, the bank is obliged to restructure the loan under certain conditions:
- Convert foreign currency loans into ruble ones - at the rate in effect at the time of concluding the updated agreement;
- Set the interest rate for the borrower to no more than 11.5% (per annum);
- “Forgive” the client a certain amount of debt - at least 1.5 million rubles (due to partial write-off and/or recalculation at a more favorable exchange rate);
- Do not charge the debtor a penalty for overdue payments (except for amounts collected by court decision and previously paid fines);
- Do not reduce the deadline for fulfilling loan obligations by the debtor.
On behalf of the state, AHML provides assistance to mortgage borrowers. This is the short name for the “Housing Mortgage Lending Agency”, through which banks receive funds in the amount of income lost from the client. That is, by calling on creditors to meet the debtors halfway, the state from the treasury covers their costs arising from mitigating the terms of the mortgage agreement (within established limits). For these purposes, 2 billion rubles were transferred to the Agency’s account.
Please note: the maximum possible amount of compensation may be increased, but not more than twice its value. A decision on this is made by a special interdepartmental commission - at the request of the debtor.
Currently, the official website of AHML contains information that restructuring of mortgage debt is possible in 2 types:
- Interest rate reduction;
- Conversion into ruble equivalent at a lower rate.
Who can count on support
The authorities dictate strict conditions for those who are going to participate in it. The August government decree significantly reduced the list of citizens for whom the state is ready to cover part of the debt. For example, previously it included employees of defense enterprises, municipal employees, and scientists. They are not on the new list.
In 2019, the assistance program applies only to the following categories of borrowers:
- Adult citizens with disabilities;
- Parents raising disabled children;
- Veterans who participated in armed conflicts of recent decades (combat);
- Parents/guardians/guardians of minor children (in any number);
- Parents who financially provide for their children who are studying full-time in various educational institutions - until the “children” reach the age of 24.
This list is closed, that is, exhaustive. However, strict requirements are imposed not only on debtors, but also on real estate that is purchased with money borrowed from the bank.
Real estate requirements
The assistance program applies to certain residential properties.
They have to:
- Be located on the territory of Russia;
- Be the only home of the borrower and his household (they are allowed to have a share in another apartment/house/room, but not more than 50%);
- Do not exceed the established dimensions of the total area of the room:
- 85 m2 – for a 3-room (or more) residential property;
- 65 m2 – for a 2-room residential property;
- 45 m2 – if a property with 1 living room is taken out on a mortgage.
It is interesting that in the previous program, important attention was paid to the cost per square meter of living space purchased with a mortgage. It should not be more than 60% higher than the regional market average. And the maximum footage was set not by the number of rooms, but by the number of family members of the mortgagor living in the mortgaged apartment. However, the updated assistance program from AHML does not contain these restrictions.
Requirements for borrowers
To participate in the program, borrowers must not only be included in the above list of “preferential” categories, but also meet very important additional criteria:
- 3 months before submitting an application to the bank for mortgage restructuring, the average income of each member of the borrower’s family, after paying the planned loan amount, did not exceed two subsistence minimums established in the region of their residence. Thus, the emphasis is on families with low and medium incomes, in which, despite the regularity of income, a mortgage loan has become an unbearable burden.
- At the time of filing an application for restructuring, regular loan payments must increase by at least 30% - compared to the amounts that were planned to be paid to the bank on the day the loan agreement was concluded. This condition excluded ruble mortgage holders, who may also be experiencing difficult financial problems, from the program. However, such a gigantic jump in monthly payments is only possible if the mortgage was taken out in foreign currency.
Required documents
It will include:
- Photocopies of documents identifying both the borrower himself and all his household members: Russian passports, “children’s” certificates;
- Documents that will confirm that he belongs to one of the categories of Russians who have the right to pay off their mortgage with the help of the state:
- certificates for children (if their presence gives the right to state support);
- veteran's certificate of the established form;
- MSEC certificate confirming the presence of disability - for himself or his child;
- paper from an educational institution confirming that the son or daughter is studying full-time, etc.;
- Documents evidencing the amount of income of the borrower or joint debtors, as well as the total income of his family members - for the last 3 months:
- photocopies of work book pages;
- 2-NDFL certificates taken at work;
- certificate of receipt of unemployment benefits (for able-bodied but unemployed citizens);
- an extract from the Pension Fund of the Russian Federation on the amount of pension for the last year (for pensioners/disabled people or when receiving benefits for a disabled child);
- statement of the amount of “guardianship” payments, etc.;
- A valid mortgage agreement concluded with the creditor bank (it must be executed at least one year before filing an application for debt restructuring);
- Schedule of monthly payments – to repay the target loan;
- Form No. 9 (provided at the passport office at the place of registration);
- An application in the established form, in which the borrower reports his own property status and that of his family members, concerns whether they have other real estate (its form can be downloaded and viewed on the official AHML website).
And even such a long list is likely to be incomplete, since different banks participating in the state mortgage subsidy program establish their own list of required documentation. It is usually posted on the electronic portals of credit institutions.
Please note: An extract from the Unified State Register of Real Estate on the ownership of the borrower(s) for the collateral, that is, for real estate purchased on credit, is no longer required by banks from applicants. Previously, they had to be taken, but now AHML itself requests this document from Rosreestr.
Scheme for receiving assistance
So, a borrower who is having difficulty repaying a loan needs to contact the lending bank and find out whether the lender participates in this government program.
If the answer is positive, the debtor will have to perform a number of actions in order to receive AHML assistance:
- You need to find out which department of the bank deals with this issue. Usually this is the department for working with debtors (or overdue debts). By phone or through the website you need to find out its location and contact information.
- By calling the department or visiting in person, the borrower clarifies what documents he needs to collect to submit to the bank.
- Having collected the necessary papers, the citizen sends them to the financial institution along with an application form. It states the reason why the borrower is seeking government assistance.
- Having received a package of papers from the debtor, the financial institution sends them to AHML for verification. It is believed that on average it lasts about a month. However, it is better to expect a longer wait, as many citizens complain that they had to wait for an answer for up to six months.
- Often, AHML requests additional documents, which the applicant is obliged to provide to him.
- If the Agency's decision is positive, the bank informs the debtor about it and sets a meeting time to draw up a new loan agreement.
- At the meeting, either a completely new agreement with changed terms is drawn up, or an additional agreement to the current document is drawn up. An adjusted schedule of regular payments is also developed and signed, and paperwork is drawn up to change the contents of the mortgage.
- A previous mortgage is requested from the bank's archives. You have to wait 2-4 weeks for it.
- Then all amended, supplemented and newly drawn up documents are submitted for registration. At this point the procedure can be considered complete.

Their complete list is given on the AHML website, along with telephone numbers where borrowers can clarify the information they are interested in. What is the mortgage assistance program?
An increase in mortgage debt is becoming a fairly large problem for Russia, especially noticeable against the backdrop of declining incomes and rising prices. Indebtedness gives rise to a whole range of interrelated difficulties, for example, a decrease in purchasing power and a slowdown in economic growth. To solve this problem, a federal program to help mortgage borrowers was launched.
What does the client get?
As mentioned above, the AHML mortgage assistance program at Sberbank is a debt restructuring. In a normal situation, restructuring is possible only for bona fide payers who fulfill their obligations without delay for a certain period (from six months). In this case, it is possible to combine several loans into one and even transfer debt from one bank to another.
Under the preferential program, debt restructuring is possible only at Sberbank, i.e. It will not be possible to refinance, for example, with VTB. In addition, mortgage refinancing is possible for certain categories of people who find themselves in a difficult financial situation, i.e. "by default" do not have sufficient funds to service the loan.
The state, represented by AHML, under the program to assist mortgage borrowers in 2018 at Sberbank, guarantees not only a review of the loan terms, but also additional opportunities:
- write-off of accrued penalties and fines if the borrower could not fulfill obligations due to circumstances beyond his control;
- revision of the terms of the contract in favor of reducing the interest rate to the minimum possible of 9.23%;
- conversion of foreign currency mortgages into rubles at a more favorable rate than the current market rate;
- payment of a compensatory nature, no more than 600 thousand rubles to one borrower.
Duration of the program
The duration of the AHML program at Sberbank has been determined - restructuring can be obtained only until the end of 2017. Whether the program will be extended further depends entirely on the intentions of the Government.
The bank cannot provide fewer benefits than those provided by the state, since its costs are financed by the state. However, Sberbank is ready to offer even more favorable conditions to loyal customers with a good credit history. Which ones exactly will be decided during negotiations.
In addition, Sberbank is ready to provide restructuring not only for mortgages, but also for car loans and regular consumer loans. However, in these cases one cannot count on government help; this is solely an initiative of Sberbank.
One more important point: despite the fact that the mortgage assistance program is being implemented by AHML, you need to contact Sberbank itself to review the terms of the agreement.
Who can count on government support
As mentioned above, during a regular restructuring, only solvent borrowers can apply for a revision of the terms. In the case of state support, the situation is diametrically opposite: socially vulnerable segments of the population can count on assistance under the AHML program for mortgages from Sberbank:
- disabled people of any group;
- participants in combat operations, including internationalist soldiers, participants in the Chechen campaigns, etc.;
- "Chernobyl victims".
Conditions for receiving assistance
The mandatory conditions for receiving the AHML assistance program from Sberbank are:
- a decrease in all family income by more than 30% with a ruble mortgage or an increase in the size of payments by more than 30% with a foreign currency mortgage (for comparison, two consecutive three-month periods are used, i.e. the last six months, while the amount of average per capita income for one month does not may exceed two subsistence levels in the region);
- making payments on a loan for a period of at least 1 year (i.e., the agreement must be drawn up earlier than 12 months before submitting an application for financial assistance from Sberbank);
- the bank must be a participant in the AHML program (Sberbank is one).
For example, a family with two minor children who took out a dollar mortgage in 2012 can qualify for assistance (the amount of payments has since doubled, i.e. by 100%).
Criteria for borrowers
Under the AHML program of state support for borrowers, Sberbank’s criteria generally duplicate the provisions of the federal program, while additional grounds for restructuring are introduced:
- dismissal from work (at the initiative of the employer or due to bankruptcy of the enterprise);
- transfer to a lower position with salary reduction;
- increase in expenses caused by the death or illness of a relative (or co-borrower);
- loss of income-generating property due to conditions beyond the borrower’s control (for example, theft of a rental car or a fire in an apartment);
- conscription into the army of the payer himself or his closest relative/co-borrower helping to pay the loan (for example, the mortgage was issued to the wife, but the husband was drafted);
- pregnancy and childbirth;
- receiving disability;
- long illness.
The borrower’s goal is to show that he finds himself in a difficult financial situation, but at the same time does not refuse his obligations and is ready to fulfill them if the bank provides him with more favorable conditions.
How to become a participant in the program
For financial assistance or beneficial restructuring, the borrower's collateral must also meet certain parameters.
Conditions imposed on mortgaged housing
Thus, in Sberbank, under the AHML support program, the criteria for a mortgaged apartment are as follows:
- This must be the borrower's only residence. In order for the premises to meet this criterion, the payer should not have more than a 50% share in any other apartment, even under the terms of privatization.
- The housing area should not be more than 45 square meters for a one-room apartment, 65 square meters for a two-room apartment and 85 square meters for a three-room apartment.
- The price of one square meter should not be 60% more than the market average on the date of registration of the mortgage. Moreover, calculations for primary and secondary housing are carried out separately, information is taken from the regional branch of Rosstat.
It is worth noting that Sberbank’s AHML program for supporting mortgage borrowers does not distinguish between types of housing - benefits can be obtained for apartments in the primary and secondary markets, as well as when participating in shared construction (even if the housing is not yet completed).
Documents for the program
In accordance with the requirements of the AHML Sberbank program, documents must be prepared by the borrower independently. The minimum package includes:
- application in the bank form (done at the end under the supervision of a specialist in mortgage programs);
- evidence of the payer’s membership in the preferential category of program participants (for example, a veteran’s certificate, a certificate from the hospital establishing a disability or chronic illness, a birth certificate in the child’s family, etc.);
- evidence of being in a difficult financial situation (copy of an employment contract, certificate from the employment department about registration, death certificate of a co-borrower, copy of a military ID, etc.);
- evidence of a decrease in income or loss of income-producing property;
- documents for the apartment - an extract from Rosreestr or a copy of the certificate of ownership, property valuation (a document executed at the time of registration of the mortgage is suitable), a copy of the purchase and sale agreement, transfer and acceptance act, etc.;
- bank documents - agreement with payment schedule, mortgage, account statement, etc.;
- an extract from Rosreestr about the amount of real estate owned by the borrower (the certificate must be no older than 30 days);
If the payer is included in the Sberbank AHML borrower assistance program, he will receive a new agreement providing for more favorable mortgage terms. Help can only be used once.
Restructuring options
Today, there are two options for providing financial assistance to needy payers:
- Providing one-time financial assistance from AHML funds. In this case, no more than 10% of the debt and no more than 600 thousand rubles are written off. The bank considers this as an early repayment and can either shorten the mortgage term or recalculate the monthly payment based on new data.
- Carrying out restructuring.
Note that the second option is implemented in the vast majority of cases. Under the assistance program for mortgage borrowers, AHML and Sberbank offer the following types of restructuring:
- payment reduction by 2 times for 18 months (AHML pays the missing amount instead of the payer), after which payment continues as usual;
- “stretching” the mortgage term, thereby reducing the monthly payment;
- deferment of principal payment for up to 6 months (i.e., the borrower pays only interest for these six months);
- postponement of the payment date;
- reduction of the interest rate to a minimum of 9.23% (if the key rate is reduced by the Central Bank, an even more intensive rate reduction is possible);
- Conversion of foreign currency mortgages into rubles at a fixed preferential rate.
Note that the first type of restructuring is always used by the bank, the others are optional.
The borrower needs to calculate which type of assistance - a reduction in the total debt or a temporary reduction in the amount of payments - will be more profitable for him. Perhaps a Sberbank mortgage specialist or lawyer will help him make the right decision.

In 2018, mortgage borrowers will be able to take advantage of government assistance under new rules. The government promises citizens to reduce their mortgage debt if certain requirements are met. The innovations mainly affected foreign currency loans.
The main essence of the state housing lending program
In order to take advantage of government assistance in restructuring a mortgage loan, the borrower will have to collect a special package of documents and write an application to his bank. If the citizen receives approval, an additional agreement to the current contract will be concluded with the borrower. After debt restructuring, the cost of monthly payments is reduced to 11.5% per annum, and the debtor receives a preferential deferment of up to one and a half years.
State subsidies aimed at reducing the principal debt on a mortgage loan are allocated from the federal budget. To control financing, the Housing Mortgage Lending Agency was created, which began to play the role of an intermediary between the lender and the borrower. Restructuring a mortgage loan under the AHML program
AHML assistance to mortgage borrowers who find themselves in a difficult financial situation in 2018 will be carried out on the basis of Resolution No. 961 of 08/11/17. Under the new program, individuals can receive financial support in the form of writing off 30% of the remaining debt, but not more than 1.5 million rubles. In addition, the borrower can count on the cancellation of the accrued penalty, which was not written off by decision of the judicial authorities.
After the home mortgage is refinanced, the cost of a foreign currency loan will be 11.5% per annum, and a ruble loan will not be higher than the current bank rate. The state can provide two types of assistance during debt restructuring:
- conversion of a foreign currency loan into a ruble loan at a reduced rate;
- writing off as much of the debt as possible.
Mortgage loan restructuring is carried out only by decision of the lender. When assigning the right of claim, no commission is charged. AHML handles the on-lending process. Under Resolution No. 961, the following categories of citizens can count on preferential borrowing:
- families with minor children;
- combat veterans;
- guardians and trustees raising young children;
- citizens with a disability group;
- individuals whose dependents are persons under 24 years of age.
An additional condition has also been established for all of the above persons. Their average monthly income for the last three months before restructuring should be less than two subsistence minimums for each family member. The minimum wage is determined in accordance with the region of residence of an individual. In addition, the second condition will be an increase in the monthly payment by 30% compared to the date of receipt of the mortgage. This clause makes the preferential refinancing program unavailable for most ruble borrowers.
At the end of 2017, to resolve the issues of clients who were not covered by the state subsidy program, a special commission was created, which individually considered applications from individuals who, despite the obvious need, did not meet the established conditions. A list of such people in need is compiled by the bank based on the personal application of the borrower. The interdepartmental commission may decide to double the maximum subsidy amount for certain groups of people in need.
There is an opinion that banks deliberately refuse citizens to refinance a loan, but this is not true, since such a procedure is beneficial for the financial institution. When assigning the right of claim, the financial loss that may arise from early repayment of the loan will be compensated by the state.
The mortgaged property must also meet certain requirements. In order to receive preferential lending, the collateral area must meet the following requirements:
- a one-room apartment should not be more than 45 square meters. m, two-room – 65 sq. m, three-room apartment over 85 sq. m;
- the cost of one square meter should be no more than 60% of the established price in the region;
- the purchased housing must be the citizen’s only one, while shared ownership of property in another building is allowed, but not more than 50% for the entire family.
It is worth noting that the requirement for the area and cost of a meter of real estate does not apply to large families. If this category of citizens has other property, then it can be quickly transferred to other relatives, and then the right to preferential lending with state support will not be lost.
What documents will be required for loan restructuring in 2018
In order to refinance a mortgage loan under the state program, you need to provide your bank with an application, documents confirming the identity of the borrower, his right to preferential lending and mortgage real estate. The bank is also provided with various certificates about the status of the existing loan and payments made. Depending on the terms of the loan, the list of documents may include additional forms, and some certificates from the general list may be optional.
A sample list of documents looks like this:
- application form for revision of the current terms of a mortgage loan under the state subsidy program with a mandatory indication of the reason;
- ID cards of all family members (passports, birth certificates);
- in case of a change of surname, the borrower provides a certificate of divorce or marriage;
- guardians will need an extract from the court decision confirming their status;
- veteran's certificate;
- a document confirming the disability group of the applicant or his children;
- an extract from a financial and personal account with information about the cohabitation of persons under the age of 24;
- a certificate from a school or university stating that the child is studying full-time;
- a copy of the work book for a working citizen with a note that the borrower is currently employed;
- for individual entrepreneurs, a certificate of registration or an extract from the Unified State Register of Entrepreneurs;
- original work book for the unemployed;
- certificate of receipt of unemployment benefits for those registered at the labor exchange;
- income certificate in form 2-NDFL from all working family members;
- tax return, patent;
- for a pensioner - a certificate of the amount of pension for the last 12 months, for a student - a document confirming the amount of the scholarship;
- current loan agreement and monthly mortgage payment schedule.
The following documents are provided for the pledge:
- property document (certificate);
- mortgage (if any);
- a statement from the borrower about the presence of other property;
- agreement of equity participation in a new building under construction;
- collateral assessment album;
- technical and cadastral passport of the premises.
After all the documents have been prepared, the package must be sent to the bank, in turn, the lender will submit the documentation for verification to AHML. In accordance with the regulations, consideration of the application should take no longer than 30 days. If it is necessary to provide additional information about the borrower, the procedure may take several months.
