4.2.6. if the Operator's Subscriber, when registering in the “Chi Gap” Application, provided incorrect, incomplete and / or distorted data
4.3. All materials posted, sent or received by the Subscriber through the "Chi Gap" Application, including, but not limited to the text of the Status, photos, videos and other communications, are collectively referred to as "Subscriber Materials". 5.2. SIP IN, IP-to-IP voice calls and IP-to-IP chat in the "Chi Gap" application are not charged, except for the payment for data transfer services in accordance with the current at the time of use tariff plan Subscriber.

6. PROCEDURE FOR REGISTRATION IN THE CHI GAP APP
6.1. The Subscriber downloads the "Chi Gap" Application from the Site or the Operator's Site.

6.8. The assignment of a Subscriber Number during the registration process means the Subscriber's consent to the terms of the current version of the service agreement and the assignment of the Subscriber Number(s), which can be found on the Operator's Website.
6.9. The Subscriber is solely responsible for the information provided by him in the Subscriber's Questionnaire in accordance with the current legislation of the Republic of Tajikistan.
7. CONSENT TO USE OF DATA
7.1. The Operator receives, collects and uses information about the Subscriber's use of the "Chi Gap" Application, including the Subscriber's personal information in accordance with the terms of the Operator's approved Privacy Policy.
7.2. By using the "Chi Gap" Application, the Subscriber agrees that the Operator may collect and use technical data and related information, including, but not limited to, technical information about the Subscriber's device, system and application software and peripherals, which is collected by the Operator to provide updates /changes in the functionality of the "Chi Gap" Application, technical support of the "Chi Gap" Application, and provision of other services related to the "Chi Gap" Application (if any).
8. CHANGES TO THIS AGREEMENT
8.1. The Operator may amend these terms of the Agreement from time to time.
8.2. Subscribers are notified of changes or termination of this Agreement by posting on the Operator's Website 10 (Ten) days before such changes come into force. This Agreement shall be deemed amended or canceled as of the date specified in the relevant notice.
8.3. 9. OBLIGATIONS OF THE SUBSCRIBER
9.1. The Operator is not responsible for any losses that the Subscriber may incur as a result of using the "Chi Gap" Application, with or without the knowledge of the Subscriber.
9.2. The subscriber is not entitled to:
9.2.1. intercept or eavesdrop, disrupt or interfere with any communication not intended for the Subscriber;
9.2.2. use any program codes - "viruses", " Trojan horses"," worms "," time bombs ", etc., designed to distort, delete, damage, imitate or violate the integrity of the "Chi Gap" Application;

9.2.5. use or attempt to use the "Chi Gap" Application to create obstacles or inconvenience to third parties, to make threats or invade the privacy of third parties;
9.2.6. use Subscriber Materials owned by third parties, unless the Subscriber has a license or permission from the person with such rights;
9.2.7. use the "Chi Gap" Application to collect any identifying information, including the names of other Subscribers;
9.2.8. influence or attempt to influence the availability and functionality of the "Chi Gap" Application, in particular, using DOS (denialofservice - denial of service) or DDoS (distributeddenialofservice - distributed denial of service) attacks.
10. REFUND POLICY
10.1. If the Subscriber believes that the calls made through the “Chi Gap” Application were billed incorrectly by the Operator, then he has the right to apply to the Operator with a written application within 30 (thirty) calendar days from the date of the disputed payment. Claims for the return of payments are not considered after 30 (thirty) calendar days from the date of the disputed payment.
10.2. The Operator reserves the right to reject a refund application if there is reason to believe that: (a) the Subscriber is attempting to use the refund policy in bad faith, such as applying for a refund multiple times for the same disputed payment; (b) the Subscriber violates the terms of this Agreement; (c) according to the information available to the Operator, the Subscriber uses the "Chi Gap" Application for fraudulent purposes or if the Subscriber's Account is used by a third party for fraudulent purposes.
11. PROPERTY RIGHTS
11.1. The "Chi Gap" application, including the Operator's Website, as well as the "Chi Gap" trademark and their copies are protected by copyright and other applicable intellectual property laws.
11.2. The Operator owns the title, copyright and other intellectual property rights to the "Chi Gap" Application and all copies, modifications and their derivatives, and the main software (including any feedback from Subscribers about the "Chi Gap" Application).
11.3. Set out in clause 13, regarding the rights of third parties to the software license are reserved. By agreeing to the software license, the Subscriber agrees to be bound by the terms in paragraph 13 regarding the software license.
12. DISPUTES AND JURISDICTION
12.1. All disputes and disagreements between the Subscriber and the Operator under this Agreement shall be resolved through negotiations. If it is impossible to resolve the disagreements that have arisen by agreement of the Parties, disputes are referred to the economic courts of the Republic of Tajikistan in accordance with the current legislation of the Republic of Tajikistan.
