The indent of the garage from the neighboring plot. Distance between house and garage
What could be easier than building a garage or building a fence? Nothing until you start building. Here the questions begin: what distance from the fence to the garage can I choose? Norms? SNiPs? Rules? Calm down, we have prepared a detailed answer about this (and not only) in this publication.
Garage on the adjacent plot: norms and rules, customs and habits
The construction of low-rise buildings today is not subject to strict construction control and regulation. The homeowner has the right to independently determine the parameters of the house and outbuildings, the location of technical services, the garden, the vegetable garden, the distance from the fence to the garage. And yet, when solving planning problems, the owner of the site must take into account some norms of Russian legislation. At least in order not to rebuild later, when it turns out that in some way the owner of the site and the house infringed on the rights of neighbors. This also applies to the rules for choosing a place for a garage on the site.

Compliance with safety rules
The first regulatory document that you need to pay attention to is the law of the Russian Federation of December 30. 2009 No. 384-FZ "Technical regulations on the safety of buildings and structures" (hereinafter - Law No. 384-FZ). Basic safety principles related to low-rise and household construction. The garage is one of those things.Principle 1. Buildings and structures should not bear the threat of mechanical damage. Buildings, constructions should not threaten people with mechanical destruction and injury as a result of these destructions. The threat of mechanical damage should not exist for other buildings and engineering structures. As an example, consider a situation where a neighbor sets up his garage in such a way that the gate of this garage, when opened, destroys the fence of your site. The situation, at least, leads to a scandal between neighbors, and, at the most, to litigation.
principle 2. During the operation and construction of houses and premises for household or technical purposes, fire safety rules must be taken into account. Today, the regulatory approach to low-rise civil construction has been relaxed. The fire hazard of an object (if it is used for business) in the field of private home ownership is determined by the owner himself. It is necessary to take into account the rules (SP 42.13330.2011, SNiPs: 2.07.01-89, 02.31.2001, 02.30.97, 2.01.02-85) and the fire safety rules established by the technical regulations (law of 07.22.2008 No. 123-FZ, hereinafter - Regulation No. 123-FZ).
Principle 3. During the construction and operation of buildings, outbuildings (including garages) and engineering facilities, it is necessary to comply with sanitary safety standards, not to use materials or technologies that pose a threat to human health.
Principle 4. The environmental implications must be taken into account. Harm to nature is prohibited.
Principle 5. The structures of buildings and structures must be designed for possible natural disasters characteristic of the area where the construction is being carried out.
Principle 6. Houses, garages, utility buildings, facilities that provide them should not cause situations that lead to injury to people. Houses, outbuildings on the site must be located in such a way as to exclude the possibility of injuring a person.
Principle 7. The building and construction today must be energy efficient. Compliance with this principle (use modern technologies energy saving) allows the owner to save on operating costs. The owner saves his money and saves natural resources and energy on a nationwide scale.
Today, there are no special requirements for such buildings as a garage for one or two cars on the territory of a private household. Compliance with these principles allows you to most conveniently locate all outbuildings on the site, as much as possible to provide for possible emergency and non-standard situations to maintain good neighborly relations.
What rules should be followed when choosing a place for a garage?
Private garage can be:- built into the building;
- adjacent to the house;
- Separate building.
When deciding where exactly to locate the garage structure, it is necessary to be guided by the principles of convenience and safety. Need to take into account general rules site planning, taking into account the interests of neighbors. To do this, it is enough to observe the norms of distances for the location of outbuildings and residential buildings on the site. Table 1 with legally recommended distances can be viewed below.
The garage should be placed at a distance of 3 meters from the boundaries of neighbors and from the border of driveways. From the street should retreat 5 meters. There are some planning solutions that allow you to build a garage that has direct access to the street. To do this, as a rule, the fence is moved a meter or two inland from the border of the site. The garage attached to the house, the distance to the fence in this case is zero - the garage gate is on the same line of the fence.
If there are open artificial or natural reservoirs, rivers, streams, then it is not recommended to install such technical structures as a garage closer than 5-20 meters to the coastline. The distance that a building should be removed from the shore depends on many reasons. For example, from the length of the river. To clarify these parameters, you can refer to the Water Code of the Russian Federation and SanPiN 2.1.4.1110-02. Note that construction in protected areas is prohibited.
Practical implementation of SNiPs
In observing the distances between objects lies the practical side of the implementation of SNiPs that regulate planning decisions on the adjacent plot of land. Table 1 below will help guide you in site planning.

As you can see, the distance from the fence to the garage is not strictly regulated by SNiP. The general recommendation is that all outbuildings (except those that have restrictions on sanitary and hygienic aspects) should be located at a distance of 1 meter from the fence.
In addition to observing the distances from the borders of neighboring sites, it is necessary to comply with the norms for the construction of residential buildings and the construction of engineering networks. When planning and designing engineering structures, the designer is obliged to provide for such solutions that will make it possible to eliminate the accident without harming the health and life of people, nature, other engineering structures, buildings.
How to equip a garage?
Each owner equips the internal arrangement of the garage according to his own principles. General condition for Maintenance car is a device or a technical recess (pit) or a lift. These facilities will help to repair the car from the bottom with maximum convenience for the repairman. The location of special devices, equipment and boxes for storing spare parts, tools, hardware, along the walls of the garage around the perimeter, will allow you to properly organize the space. BUT right choice Automatic gates will solve many problems. Automation for arranging such a modern gate device can be selected here.
The regulations provide for a mandatory ventilation device for a room such as a garage. Previously, the amount of fuel and lubricants that could be in the garage was regulated (for example, gasoline should have been in the garage no more than 20 liters). Today, these rules have been abolished. However, the principle of reasonable care should stop the owner from turning the garage into a fuel depot. Moreover, there are very strict standards for the fuel depot.
Fence and garage
Regarding the fence, the garage can be located both on the same level with it (adjacent to the fence), and at a distance from it. The location of the garage on the same line with the fence can be from the side free from proximity to other areas, since the recommended distance for this type of building from the land of neighbors is 3 meters. The fence should recede from the border of the neighbors by 1 meter. But if the fence is common to two sections, then they do not indent.
If the garage is built at a distance from the fence, then the recommended distance from the fence to the garage is 1 meter. It's easier to do so necessary functions care of the building and the fence itself.
Site fencing requirements
There are three main regulatory documents governing the planning of the territories of garden plots:- Law No. 66-FZ dated April 15, 1998;
- SNiP 30-02-97 (updated version - SP 53.13330.2011);
- SP 11-106-97.
According to the set of rules 53.13330.2011 (modern edition of SNiP 30-02-97), a mesh fence should be erected around the perimeter of garden plots (clause 6.2 of SP 53.13330.2011). For plots under individual housing construction, this requirement is less relevant. The fence from the side of the street can be metal, solid, up to two meters high. If the facade of the house faces a busy highway. That the fence is allowed to be placed above 2 meters.
Often the best option fencing is a metal picket fence. You can choose this type of fence for your site.
But between the plots, the fence cannot be higher than 2 meters; a lattice or mesh fence is recommended, especially in places where neighbors have vegetable gardens. If the plots are used for recreation, and not for growing vegetables and fruits, then the fence between the two plots can be continuous.
Advice: take a neighbor's written consent to install a fence that has a continuous (non-mesh) coating (clause 6.2 of SP 53.13330.2011).Conclusions on the construction of the garage
A car is a complex technique and has its own risks: technical and technological. Even with passive storage of this technique in the garage, it can cause emergencies- sudden fire, explosion of fuel and lubricants can occur (if there is no ventilation in the room, for example). Therefore, the garage carries the threat of some risks. However, recent legislative changes, the ongoing liberalization of the construction sector, especially individual construction, have simplified the rules for the construction and operation of individual garages. A question often arises from developers: “What should be the distance between the garage and the fence?”
The location of the garage on the site is subject to general rules established in SNiP, SP, laws, links to which are given in the article. Failure to comply with the recommendations of SNiP does not entail criminal liability, but it can create situations in the life of the violator in which litigation is indispensable. The rules for building a garage limit the distance to the fence to one meter. But this building can be on the same line with the fence.
Norms of distances from the fence during construction
On the Internet, you can find many questions on how to properly build a fence, whether it is possible to place a garage near it, what should be the distance from the garage to the fence. Citizens often bombard lawyers with similar questions during a personal meeting. For example, Alexey M. from the city of Saratov is interested in - at what distance is the garage being built from the fence? If so, how to warn the neighbors about this, what document to show or at least refer to it? The answer to Alexey's question, as well as the construction standards for the main buildings on the site, you will find in our today's material.
What the docs say
Indeed, there are certain sanitary conditions and norms according to which a garage, fence, etc. must be built. The minimum length to the border of the neighbor's land should be equal to:
- Three meters if it's a building.
- Four meters, if we are talking about a building that contains a bird, small livestock.
- One meter if other buildings.
- Four meters if tall trees, two meters if medium tall.
- One meter if an ordinary shrub.
Since the garage can be classified as "other buildings", during the construction you will need to step back only one meter. These norms are provided for by SP 53.13330.2011 Code of Rules. This is true if there are no closely standing buildings on the other side of the fence on the neighboring plot.
If the garage is close to the fence at a distance of less than one hundred centimeters, this will already be considered a violation. At the same time, garages can be either free-standing or built-in, attached to the garden house, buildings on the site.
Fence rates
For many people who recently became owners of a land plot, it becomes a real discovery that even on their own territory it is impossible to place buildings wherever they please. The location of all buildings and even enclosing structures is regulated by legislative acts.
Returning to the law SNiP 30-02-97, as amended on March 12, 2001, there are certain rules for building a fence. If this is a fence between neighbors, then the sections should have transparent fences (lattice, mesh). This is done with one single purpose - to prevent shading of the site.
What should be the height of the fence? According to the norms, it is possible to build a fence, the height of which will not exceed 150 centimeters. Of course, neighbors can agree on a different height of the fence orally, but it is better to fix the agreement in a written contract. It will have legal effect on any issues if the case goes to court.
It should be understood that SNiP is not considered a law as such. He recommends specific norms. Please note that your locality may issue its own regulations based on these rules. This is done in order to conform with the climatic and regional features of the territory.
For example, in the Volgograd region, it is allowed to build a fence that will stand on the boundary, not more than 2.2 m high. Its transparency must be at least 50% of the total area of \u200b\u200bthe fence. If the fence is completely opaque, the maximum height of the fence should not exceed 0.75 m.
Placement of the garage relative to the "red line"
It has already been noted above that it is not so difficult to comply with the norms of indentation from the fence adjacent to the neighbors. One meter is enough for you to serve the outer walls of the building. And the water from the roof of the garage will definitely not drain to the neighbors.
Another thing is if the plot has access to the roadway. Therefore, it is not allowed to place a garage in the same plane with a fence here. According to the rules, it is necessary to observe at least a five-meter indent from the fence, which is located on the "red line", or three meters from the fence, if it separates the site from the driveway on the side.
Of course, this standard is only a recommendation. However, if it is not observed, the consequences may not be very pleasant. But there is a little trick, which we will tell you now. It will allow you to obtain a legal building permit from the garage directly to the street.
So, all you need is to build a fence not at the border, but by indenting at least one meter deep.
Safety regulations
So, we found out what should be the distance to the garages on the plot. Are there any rules fire safety?
It turns out that the fire distance between structures within the same garden plot is not standardized at all. But if the buildings are located on different garden plots, this rule is valid and depends on the material of the supporting and enclosing structures. It all depends on the combustibility of materials. If it is a stone structure, the distance should not be less than 6 meters, if it is a concrete building - 8 meters, if the building is made of reinforced concrete - ten meters.
How distance between objects is measured
It should be understood that one person can take measurements and say that the distance between the garage and the fence is 1.2 meters, while the other can see only 90 centimeters. To prevent this from happening, you need to learn how to correctly measure the distance. Remember: the distance from the house is always measured by the projection of its parts that protrude, as well as the base. If, due to certain circumstances, the buildings on the site are located at a distance of less than one meter from the neighboring site, it is better to make a roof slope in your direction.
It also happens that an outbuilding is in contact with a residential building in a summer cottage. In this case, you need to comply with completely different rules. You will need to make an entrance to each of the rooms at a distance of 7 meters.
six meters law
We talked about the fact that the construction of a garage is allowed if it is one meter from the fence on the site. However, there is also a rule of six meters. Its essence lies in the fact that the distance from your garage to the building on the neighboring site should be at least six meters. If there are no closely spaced buildings, then there are no obstacles to building a garage on your territory.
But why six meters and not four or, say, seven? This standard is due to fire safety regulations. If one object ignites, the flame can easily move to another building. This is more than true for the garage. So the following conclusion can be drawn. We measure six meters from the nearest building of neighbors and boldly begin construction.
By the way, do not forget that if you are not sure about the suitability of the land for building a garage or something, it is better to order a geological survey of the land. This will make it possible to understand whether the soil will sag in the next few years.
YurClub Conference
The distance from outbuildings to the red lines of streets and driveways must be at least 5 m. See also RULES FOR THE ESTABLISHMENT AND USE OF ROADLANDS OF FEDERAL PUBLIC ROADS. (PP 1420, 1998) p. 2: Roadsides of federal public roads - plots of land adjacent on both sides to the right of way of the specified road, each with a width of at least 50 meters, counting from the boundary of the right of way.Plot layout
These requirements are displayed on the layout of the master plan for development; residential buildings on personal plots should be placed in accordance with the development plan of the area and with a set indent from the red lines; the fence of personal plots should not protrude beyond the red line of the street. the most rational placement of functional zones of infrastructure, depending on the terrain, the size of the site and its orientation to the cardinal points, illumination, the direction of predominant winds, the main purpose of the estate (recreation, gardening, raising pets) and a number of other factors; minimum land acquisition for the entire building complex and footpaths; the shortest distances for moving between buildings; The house is the main building object of the site.Distance between house and garage
If the elements protrude by more than 50 cm, the distance is measured from the protruding parts or from their projection onto the ground (cantilevered roof, elements of the second floor located on poles, etc.). 3. The minimum distances between buildings located on the same land plot should be: the distance from a residential building (or house) and a cellar to a latrine and a building for keeping small livestock and poultry - 12m; distance to the shower, bath (sauna) - 8 m; the distance from the well to the latrine and composting device is 8 m. The indicated distances must be observed both between buildings on the same site, and between buildings located on adjacent sites.Necessary indents from the boundaries of the site and neighboring buildings for individual construction
And in any case, it must be remembered that from the future residential building to the border of the neighboring site, the distances for sanitary conditions should be at least 3 m. In addition, one should not forget about the necessary indents from the foundation of any building (house or outbuildings) to engineering networks (cables and power communications at least 60 cm. gas pipelines at least 2 m., etc.).Placement of the house on the site
Each village has its own building line, which must be followed, if the building line is 8 meters away, then it is forbidden to locate a house closer than eight meters. (Fig. 3) Note: Single-family houses, including block houses, belong to class F1.4. The degree of fire resistance of the building depends on the materials from which the house is built, it is determined by the designer and indicated in the project. In addition to a residential building, developers place such buildings on their sites as baths, gazebos, households. The distance of buildings from the neighboring site (neighbors retreated only 1 meter)
The garden house must be at least 5 m from the border (red line) of the street, at least 3 m from the driveway, and outbuildings - no closer than 5 meters. In accordance with the same SNiP, an outbuilding can be adjacent to the house, but the premises for small livestock and poultry must have a separate entrance located at a distance of at least 7 meters from the entrance to the house. The garage can stand alone, attached or built into an outbuilding or house, subject to all sanitary and fire safety standards.Distance from the fence to the building: SNiP, standards and practical implementation
The first thing that these regulations are the distances between the buildings themselves. According to the current fire regulations, houses on private property cannot be built close to each other, regardless of how far from the fence to the building was maintained. This is due to the fact that in the event of a fire, it is possible to burn out not only the ignited building, but also those adjacent to it. If the building is made of completely non-combustible materials (stone, brick, concrete), then it is necessary to maintain a distance of 6 meters to the same building, 8 meters to a building with wooden floors protected by metal tiles or corrugated board, and 10 meters to a wooden house. of non-combustible material with a roof on wooden rafters, protected by slow-burning material, is built 8 meters from the same houses or houses with less combustibility, and at least 10 meters from wooden houses. The most difficult thing is with wooden buildings or with houses on a wooden frame.Summer cottage 6 acres - features of planning and arrangement
If the width of your site, subject to all norms, allows you to move the house in one direction or another, then it is better to do this to save usable space. Having retreated the prescribed 3 m from the neighboring site and observing the fire gap, you will leave a free area between the house and the fence of the neighboring site on the other side for the construction of various sites, a lawn, a garden or a kitchen garden. - living room in a one-room apartment (house); - at least one living room in a 2-room and 3-room apartment (house); - two living rooms in a house with more than 3 rooms. And, of course, an important point in the location of the house is the view from the windows. At the same time, fire-prevention distances between buildings and structures in each group are not standardized, and the minimum distances between the end buildings and structures of the groups are taken from Table 2. Table 2 - Minimum fire-prevention distances between the end buildings and groups of buildings in garden plots m A B C A Stone, concrete, reinforced concrete and other non-combustible materials 6 8 10 B The same, with wooden floors and coatings protected by non-combustible and slow-burning materials 8 8 10 C Wood, frame enclosing structures made of non-combustible, slow-burning and combustible materials 10 10 15 6.6 The garden house must be at least 5 m from the red line of streets, at least 3 m from the red line of driveways.
All about outbuildings on your site
If the outbuilding is integral part buildings (for example, a garage, a bathhouse and a house as a whole), then an outbuilding as an object of law is absent here. Outbuildings - service buildings and other structures that perform auxiliary functions for housekeeping (part 2, article 1 of the Technical Regulations of the Republic of Belarus "Buildings and structures, Construction Materials and products. If there are buildings or structures protruding more than 1 m, made of combustible materials, the distance between these structures is taken. 3. The distance between the walls of buildings without window openings may be reduced by 20%, with the exception of buildings IIIa, IIIb, IV, IVa and V degrees of fire resistance. 7. For two-story buildings of frame and panel construction of the V degree of fire resistance, as well as buildings covered with combustible materials, fire distances must be increased by 20%.
What is the distance to the boundaries of the site can be set to build a house
According to building codes, the distance on the site from the residential building to the fence is at least 3 m. If the fence overlooks the roadway, then the distance from the dwelling to the fence must be at least 5 m. The distance between neighboring houses is set by the rules from 6 m to 15 m.Such a spread in meters is primarily due to the materials from which both houses and other buildings are made, in compliance with local government legislation and fire safety standards. 1) The house is built of non-combustible materials (brick, concrete, stone).
Construction on the plots of IZHS and LPH
The land plot of private household plots can be used for construction in the same way own house. It is not necessary to grow chickens, goats and pigs on it or arrange beehives, but it is also very beneficial to have such an opportunity. The previously existing differences in the possibilities of construction between plots for individual housing construction and private household plots, garden and summer cottages on the territory of settlements became insignificant in accordance with the Resolution of the Constitutional Court of April 14, 2008 N 7-P. In the suburban real estate market, both among the townspeople planning to live outside the city, and among the residents of towns and villages themselves, IZHS and LPH plots are in great demand, because they do not need to carry out the so-called “land transfers”, which allow them to build a residential building of capital construction and decide yet simple questions about registration (registration) in this house. In addition, on the lands allocated for individual housing construction in accordance with the law, local municipalities must organize an effective engineering and social infrastructure. By purchasing a land plot of IZHS, you can count not only on the provision of territories for IZHS with the necessary engineering communications, but also on the availability quality roads, systematic transport links, healthcare facilities, education, shops and other socially significant facilities. AT winter period Roads must be cleared of snow and ice.Basic fire safety requirements for garages
Oiled rags are disposed of. It is forbidden to divide parking spaces into separate boxes using partitions. Service premises are fenced off with type 1 fire walls. fireproof flooring must prevent the spread of flame and comply with category RP 1. Used automatic systems fire extinguishers for the garage.Starting any construction, it is necessary to carry out a huge preparatory work, which will include not only the creation of a project, the choice of design, etc. Many things will have to be taken into account, not related to the desires of the future owner, but to the requirements of the law and the interests of neighbors. One of these types of construction is the construction of a garage on your site. Few households do without this structure. Even if you don’t own a car, various agricultural machinery, tools, and garden interior items always find their place in the garage, which are stored for the winter. What requirements the law imposes and at what distance from the fence you can build a garage, you can find out from this article.
Location selection
The first thing to start with is to figure out where the future building will stand. Here you need to take into account the requirements of the owner himself, what equipment will be stored inside, how and where it will be used. The reasonable dislocation of the described structure on the site is also important. A building located too far away will require the organization of access roads to it, which, in addition to their high price, will also cover a significant part of the useful fertile soil, and another more worthy use can be found for it. At the same time, it is necessary that all norms and rules are observed, the interests of neighbors are not violated, and the distance from the fence to the garage is observed.
The civil legislation of Russia provides for the absence of a special permit for the construction of a garage, on the one hand. On the other hand, a garage is an outbuilding, the construction of which still requires all permits.
Garage device
The garage can be built separately from the residential building, or it can be part of it. It can also be located on the site in different ways, but in any case, it is necessary to observe the distance from the garage to the residential building. The most rational would be the construction of such a structure next to the red line, but not directly on it. This is due to the need to stop vehicles before entering and leaving for various purposes, for example, picking up and dropping off passengers or opening the gates of the garage itself. The latter, by the way, too, if it is not a rolling gate, opening outward will create a hindrance for everyone, and opening inward - take valuable space.
The final choice is always up to the owner, if the red line does not run along the outer boundary of the site. In this case, the rule applies that any buildings should be no closer than 5 meters to the outer boundary of the site.
Safety
Structures made without building a foundation are classified as temporary buildings and are not regulated by any laws, since it is possible to transfer these buildings at any time to another place. Capital construction should be based on compliance with fire and sanitary safety rules. They are related to what material the structure is made of and strictly regulate the distance from it to other buildings, including neighboring ones. These norms are as follows:
- The distance to the nearest neighbor's building should be not less than 6 meters, it can be reduced by written agreement of the parties
- If one of the neighboring buildings is made of combustible materials, then the distance between it and the nearest non-combustible structure cannot be less than 10 meters
- If both nearby buildings consist of combustible components, then the distance between them cannot be less than 15 meters
A positive factor will be the arrangement in close proximity to the future construction of a complete set of fire extinguishing equipment. Indoors it is worth using protected illuminators. Having a fire extinguisher, and more than one, would also be welcome.
Construction documents
Capital construction can be started only after obtaining a permit for the start of construction work issued by the local administration. This permit is issued on the basis of the general urban development plan. On the general drawing of the plan of the plot of land, the locations of the buildings, their sizes and distances from each other will be indicated, and the distance from the garage to the neighboring plot will also be indicated. This drawing is submitted to the architecture department, where, after verification, a building permit is issued to the future developer.
Distances when building a garage
The construction of any commercial building is regulated SNiP 2.07.91-89 and SNiP 30-02-97, as well as the set of rules 53.13330.2011. These acts establish a number of standards, where they stipulate what should be the distance from the garage to the fence, and the distance from the house to the garage.
The distance from the fence to the garage - 1-5 meters
When determining how far a garage can be built from the fence of neighbors, one must be guided by two rules written out in the legislation. Distance defined for the garage to the neighbor's fence 1 meter, but on the condition that other neighboring buildings will not be closer than 6 meters. Otherwise, you need to count from them.
The distance from the garage to the boundary of the site from the side of the street is tied to the norm, which indicates that the garage can be built no closer than 5 meters from the red line. Where the fence will be located in this case is not regulated in any way. Therefore, if the external fence of the site runs along the red line, then the distance to it from the garage will be 5 meters. If the fence structure is away from the red line, then the distance will be chosen at the discretion of the developer, based on his personal preferences.
The distance from the garage to the residential building - from 3 meters
It happens that the garage has a common wall with the main residential building. It is not uncommon for options when the room for transport is located inside the house. Both of these options turn such a combination of buildings into a single structure. If, nevertheless, the garage is built at some distance from other buildings, then the distances between their boundaries and the garage should not be less than 3 meters. This is due to fire requirements and ease of maintenance of buildings. In this case, the distance between the house and the garage can even be significantly increased by placing these buildings on opposite sides of the site. This will allow not only to comply with all legal requirements, but also to use the space as rationally as possible, while ensuring the complete safety of your home in the event of a fire.
Conclusion
SNiP, which regulate the distance from a residential building to a garage and the distance from a garage to a fence, can be violated by agreement of the parties. But it should always be remembered that when one of the owners of neighboring plots changes, such non-compliance may lead to litigation and the requirement for forced dismantling of the building. At the same time, the term limitation period is equal to three years. If during this period there were no disagreements with the neighbors, then construction in violation of SNiP in terms of the distance from the neighbor's house to the new garage will be considered legal. Such situations are also not uncommon, but always risky.
